ULTIMATE MORPHE X BEIS CHEEK THRILLS COMPETITION TERMS AND CONDITIONS

These terms and conditions (the “Terms”), together with the Morphe terms and conditions apply to the Ultimate Morphe x Beis Cheek Thrills Competition (the “Competition”) which the Promoter may run and promote on its and/or Morphe's website, social media platforms or otherwise. These Terms prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. By participating, all entrants will be deemed to have accepted and be bound by these Terms.

PROMOTOR

COMPETITION

To celebrate the launch of the NEW! Cheek Thrills Face Trios We will be promoting a competition exclusively at the Cheek Thrills pop up sites in Selfridges in London and at the Trafford Centre.

1 person will be selected [at random from all valid entries received] to win the ‘Ultimate Morphe x Beis Cheek Thrills Suitcase and contents’.

To be entered into the prize draw, participants must complete the following steps:

a) Visit the pop up site at Selfridges in London or at the Trafford Centre to obtain the QR code link to enter the competition;

b) Confirm that you have read and agree to be bound by the Morphe Terms and Conditions and these Ultimate Morphe x Beis Cheek Thrills Competition Terms and Conditions (as part of the online entry process); and

c) Follow the online entry instructions and provide your name and a valid email address.

You must be entering from, and be resident in, the United Kingdom to be eligible to win the prize.

Only one entry for each entrant will be accepted, multiple entries are not permitted and will not be counted.

The Competition is free to enter and no purchase is necessary.

COMPETITON PERIOD

The Competition will run for the following period (being the “Competition Period”): 3rd April 2025 at 00:01AM GMT and close on 27th April 2025 at 11:59PM GMT (the “Closing Date”). Entries received before or after the Competition Period will not be eligible.

PRIZE

The Prize is the ‘Ultimate Morphe x Beis Cheek Thrills Suitcase’ comprising as follows (subject to availability) (the "Prize"):

The total RRP value of the Prize (as at the date of these Terms) is as follows: UK: GBP (£)£767

There will be 1 winner of the Prize.

There is no cash alternative available for the Prize. If any item comprising the Prize is not available, the Promoter will award a reasonable equivalent. The Promoter is not responsible for any additional costs or expenses incurred by the winner in relation to the Prize including (without limitation) any travel costs incurred collecting the prize, other than any specifically listed as part of the Prize and for the periods of time specified (where applicable).

WINNER SELECTION AND NOTIFICATION

Entrants who have successfully entered the competition will be added to a computerised random generator from which the Promotor will randomly select one (1) valid entry. The winner will be contacted via email (to the email address provided on entry to the Competition) following the Closing Date and in any event on or before the 30th of April 2025 (the “Announcement Date”).

The Promoter will send the surname and county of the winner to anyone who writes requesting details of the winner[s] and who encloses a self-addressed envelope to the Promoter's address set out at the beginning of these Terms. If you object to your surname and county being published or made available, please send an email to the Promoter at the address given above. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

ELIGIBILITY AND PARTICIPATING COUNTRIES

You must be 18 years old or over to enter the Competition.

The Competition is open to persons entering from and resident in the United Kingdom only.

Only one entry for each entrant will be accepted, multiple entries are not permitted and will not be counted.

The following persons are excluded from participating: a) employees of the Promoter and its associated companies or group companies; b) anyone professionally associated with the Competition, including employees of Morphe stockists and retailers; and c) members of the immediate families or households of (a) and (b) above.

By entering the Competition, entrants confirm that they are eligible to do so and to claim the Prize and that all information submitted by them is true and accurate. It will be the Promoter’s sole decision (acting reasonably) as to whether any eligibility requirements have been met and the Promoter may require evidence or confirmation that eligibility requirements have been met from entrants before awarding prizes. Where legally required to do so, the Promoter can provide translations of these Terms upon request.

Entries that are generated by a computer or other software or are incomplete, will are not valid and will be disqualified.

CLAIMING THE PRIZE

The Promoter will make all reasonable efforts to contact the winner[s]. If the winner[s] cannot be contacted or are not available or have not claimed their prize by responding to the Promoter within 14 days of the Announcement Date, the Promoter reserves the right to select a new winner from the valid entries that were received during the Competition Period. The Prize may not be claimed by a third party on the winning entrant’s behalf. The Promoter does not accept any responsibility if they are not able to take up the Prize. The Prize will be dispatched to the postal address supplied by the winning entrant/entrants via recorded delivery within 30 days of the Announcement Date. The Promoter accepts no responsibility for the Prize being lost, delayed, or damaged in the post or is otherwise not received by the winner.

DATA PROTECTION

See section Winner Selection and Notification regarding the announcement of winner. The Promoter is committed to complying with the UK General Data Protection Regulation as defined in section3(10) and as supplemented by section 205(4) of the Data Protection Act 2018 (the “Relevant Data Protection Laws”).

By entering the Competition, entrants acknowledge that the Promoter (and its group companies on its behalf), may process, store, distribute and/or otherwise use the information (including any information which is personal data, as defined in the Relevant Data Protection Laws) entrants provide in their entry and in the process of entering. The Promoter will process this information on the basis of the Promoter’s legitimate interests in managing and administering the Competition, specifically : (i) to enable it to administer entrants’ entry including deciding whether the entry accords with these Terms; (ii) to notify entrants if they are the winning entrant; (iii) to share with organisations or agents assisting with the conduct of the Competition and fulfilment of the prize to enable them to provide their assistance; (iv) to announce the winner of the Competition in any media or press and to respond to others’ enquiries as to who the winner is in accordance with these Terms; and (v) for any other reasonable and related Competition purposes. For the purposes of the Competition, the Promoter will only disclose entrants’ personal data to those of its group companies and third-party service providers who need it for the purposes listed above. The Promoter will not use the information provided by the entrants for any purpose other than for the managing and administration of the Competition, unless the entrant has provided consent to marketing emails. Where an entrant consents to receiving marketing emails from the Promoter, the Promoter will use the information provided in order to send marketing emails. Entrants are not required to consent to receiving marketing emails in order to enter the Competition and may withdraw their consent to marketing at any time. GENERAL

· If the Prize includes an event that takes place on a fixed date or otherwise involves fixed dates, it is the responsibility of the winning entrant to ensure that they and any nominated guest (if applicable) are available. If the winning entrant or any nominated guest (if applicable) is unable to attend for whatever reason, the Promoter is under no obligation to make alternative dates available and/or to provide an alternative Prize.

· The winning entrant and any guest (if applicable) shall not, while using the Prize, display or publicize any political slogans, homophobic language, images of a lewd or explicitly sexual nature, images containing logos of competitors of the Promoter or any overt brand sponsorship or anything else deemed to be ambush marketing, or content which is defamatory, obscene, illegal, vulgar, offensive or otherwise unsuitable or infringes others’ rights (including intellectual property rights).

· The Promoter will not accept responsibility for entries that are incomplete, lost, damaged or delayed in transit (if applicable), regardless of cause, including, for example because of any postal failure, equipment failure, technical malfunction or any systems, satellite, network, server, computer hardware or software failure or malfunction of any kind.

· The Promoter reserves the right at its sole discretion to disqualify from participation in the Competition, and any other competition or promotion offered by the Promoter from time to time, any individual it has reason to believe is tampering, or has tampered, with the operation of the Competition, or to be acting in any manner deemed by the Promoter (acting reasonably) to be in violation of these Terms (including, without limitation by making multiple entries), relevant laws and/or regulations and/or any third-party rights.

· If the Promoter subsequently discovers the winning entrant is ineligible, has breached these Terms or is suspected of engaging in any other foul play or unethical conduct, then the Promoter reserves the right (at its absolute discretion) not to award the prize to that entrant and award the prize to another entrant who will be selected by the Promoter in accordance with these Terms. In that event the original winning entrant agrees to return the prize (at his/her expense) immediately to the Promoter no alternative prize will be awarded to the original winning entrant.

· The Promoter is not responsible for any damage or loss suffered by any entrant where such damage or loss was not at the time of entry into the Competition a reasonably foreseeable consequence of a breach of these Terms by the Promoter. In any event, insofar as permitted by law, the maximum liability of the Promoter and its associated or group companies to any winning entrant shall be limited to the cash value of the Prize.

· The Promoter will not be held responsible for the failure to fulfil the obligations of third parties involved in this Competition, although the Promoter will always try to minimise the effect to the entrants of any such failure.

· Nothing in these Terms shall operate to exclude the Promoter’s liability: (i) for death or personal injury as a result of its negligence; (ii) for fraud; or (iii) further than is permitted by law.

· The Promoter reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary to do so without prior notice. The Promoter reserves the right to cancel or amend these Terms at any time without prior notice.

· The Promoter may assign the benefit of these Terms in whole or in part to any group company and/or any third party.

· These Terms shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland.
